When retained by an insurer to protect the interests of the insured, we will have two clients. When that happens, we always need to consider possible conflicts of interest (see advice above on this) and need to be engaged by both clients. It is customary to have slightly different retainers. The retainer with the insurer is typically for a period of years and to help with multiple claims. The retainer for each insured is to help them and the insurer on that one matter.
