Conflicts explained

We are not permitted to act in a situation where a conflict of interest exists, save for certain very limited exceptions. Conflicts can arise in three situations.

  1. Where we act for two or more clients in a matter and we have or may have conflicting duties (e.g. acting for both sides in litigation) ("Client Conflict").
  2. Where we act for two or more clients and the information we hold for one client would be of material interest to the other client, if disclosed ("Information Conflict").
  3. Where the interests of the firm and/or its lawyer conflict with those of the client ("Own Interest Conflict").
