Conflicts explained
We are not permitted to act in a situation where a conflict of interest exists, save for certain very limited exceptions. Conflicts can arise in three situations.
- Where we act for two or more clients in a matter and we have or may have conflicting duties (e.g. acting for both sides in litigation) ("Client Conflict").
- Where we act for two or more clients and the information we hold for one client would be of material interest to the other client, if disclosed ("Information Conflict").
- Where the interests of the firm and/or its lawyer conflict with those of the client ("Own Interest Conflict").
