Further, this is determined at the court's discretion, so in practice it is not possible absolutely to ensure that a retainer with a minor will be binding. However, the risk of our retainer being set aside can be minimised as per our "Contracting with Minors" guidance note. For additional security, parents and/or guardians should also instruct us on a joint and several basis. In such cases, Costs on Account are highly recommended.
