Contracting with minors

Only €˜contracts for necessaries', and then only if on reasonable terms and made by someone with mental capacity, are binding. Further, this is determined at the court's discretion, so in practice it is not possible absolutely to ensure that a retainer with a minor will be binding. However, the risk of our retainer being set aside can be minimised as per our "Contracting with Minors" guidance note. For additional security, parents and/or guardians should also instruct us on a joint and several basis. In such cases, Costs on Account are highly recommended.
