We are sometimes asked by clients and intermediaries to sign up to an NDA. Our position is that we will not sign an NDA and that the confidentiality provisions of paragraphs 6.3-6.5 in the Code are more than adequate. The SRA has a helpful guidance note on Confidentiality of Client Information' which is worth reading in full. This should give your client all the reassurance they need regarding our duty of confidentiality. This duty applies pre-retainer and survives termination of the client relationship.
