You have an option to report the (non-serious) misconduct of other law firms and solicitors to the SRA. You must report any serious misconduct. You cannot threaten to report the other side, you either report or you do not. Where the client wishes you to make a report, then you can and can help the client make its own report. That would be chargeable work, if so instructed. You should call the Director of Operations and Compliance to discuss any concerns and whether our reporting obligations are engaged. Any report you make should be made in conjunction with the Director of Operations and Compliance. The interplay between making a report and your obligations of confidentiality and privilege can be complicated, and the Director of Operations and Compliance will help you navigate these issues.
